Please note that Synergy is only collecting or assisting in collecting the premium deposit on behalf of the insurer you have chosen to buy the policy. The acceptance of the deposit as premium and final issuance of the policy is subject to the underwriting norms and discretion of the Insurer whose policy you have chosen to buy on which Synergy has no control. Synergy will ensure that the amount is refunded by the insurer in case there is no ultimate issuance of policy.

By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’), along with the terms and conditions as stated in our Privacy Policy (please refer to the Privacy Policy section below for more information).

Synergy is not authorized to approve or reject insurance claims under an insurance policy on behalf of the insurance company in any manner whatsoever.

2. Use and Conduct

By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as ‘Resources’), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Unless otherwise expressed, Synergy expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

10. Nominee Assistance Program

  • Synergy has merely partnered with various third-party experts in order to facilitate extended services to the users purchasing Term Insurance. The services provided by the third party(s) are provided by them in their capacity as independent service provider(s). Synergy does not provide the services in any capacity whatsoever. Synergy does not endorse the services of the listed partners. Synergy shall not be liable for any payment obligation in relation to the services provided under the Nominee Assistance program.
  • Synergy shall not be liable for any act(s)/omission(s) of the partners and/or any defect/deficiency in provision of the listed services including their refusal to provide the services. Any third-party facility/offer(s)/service(s)/product(s) (“offer”) shall be subject to the terms and conditions of such third party which shall be applicable to the user. Synergy does not endorse, make any representation and shall have no liability or obligation whatsoever in relation to such third-party offer.
  • All such third-party offers shall be availed by the user at their own risk and responsibility. Synergy shall not be liable for any payment obligation in relation to such third-party offer, which shall be the user’s responsibility.
  • Synergy is only an insurance broker and can assist with any insurance claims only to the extent of liaising with the insurance company. Any insurance claim shall be processed by the insurance company subject to their terms and conditions and the insurance policy.
  • Synergy reserves the sole right to modify, amend, change, refuse or revoke their respective services, any offers including third-party offers herein at any time without assigning any reason and without any liability and notice.
  • These terms and conditions for the Nominee Assistance Program are in addition to all other terms and conditions provided hereunder including the FAQs, and all these terms and conditions and FAQs are legally binding on the user. Synergy reserves the sole right to modify, amend, change or revoke these terms and conditions including the FAQs without any notice at any time and all such terms and conditions and FAQs as amended from time to time shall be legally binding on the user.

Any disputes arising pursuant to these terms and conditions are subject to the exclusive Courts of competent jurisdiction located in Mumbai, Maharashtra, India.

11. National Do Not Call (NDNC):

You are authorising Synergy to override the Do Not Call (DND) settings to reach out to you over calls, SMS, emails and any other mode of communication. This authorization will override your registry under NDNC. This consent shall be collected and retained in compliance with the Digital Personal Data Protection Act, 2023 and applicable TRAI regulations.

12.  Force Majeure

Any Force Majeure Event shall mean any event that is beyond the reasonable control of Synergy and shall include but not be limited to war, riots, fire, flood, acts of God, explosion, strikes, lockouts, slowdowns, pandemic, computer hacking, unauthorized access to computer data and storage devices, computer crashes, acts of state, governmental, legal or regulatory actions prohibiting or impeding Synergy from performing its respective obligations under the contract.

13. Modification of Terms

Synergy Insurance Broking Services Private Limited reserves the right to revise, update, or modify these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms periodically. Continued use of the Website after any such modifications shall constitute your consent to such changes.

1. Introduction:

The Insurance Regulatory and Development Authority of India (IRDAI), vide its Guidelines on Insurance e-commerce bearing number IRDA/INT/GDL/ECM/055/03/2017 dated 9th March 2017, mandates every licensed Insurer or an Insurance Intermediary or any person recognized by IRDAI, desiring to set-up an Insurance Self Network Platform (‘ISNP’) for selling and servicing of insurance products, to have a board approved pro-active fraud detection policy for the insurance e-commerce activities. Accordingly, the Board of Directors of Synergy Insurance Broking Services Private Limited (the “Company”) has approved this Fraud Detection Policy (‘Policy’) by considering the frauds including e-commerce fraud that the Company could be exposed to. The Policy shall provide guidance with respect to prevention, detection, investigation and mitigation of any fraudulent activities perpetrated on it.

2. Objective:

The objective of this Policy is to put in place effective Fraud Monitoring framework and ensuring that management is aware of its responsibilities for the detection and prevention of fraud and for establishing procedures to prevent fraud and/or detect fraud on its occurrence. Further, this Policy also ensures development of control measures at an organizational level and conducting investigations. The Company is committed to conducting business in an environment of fairness and integrity and will strive to eliminate fraud from all operations. The Company adopts a “Zero-Tolerance” approach to fraud and will not accept any dishonest or fraudulent act committed by internal and external stakeholders. The Policy shall also provide guidance with respect to prevention, detection, mitigation and investigation into fraudulent activities in relation to its business operations including but not limited to its e-commerce activities.

3. Applicability:

The Policy applies to any fraud or suspected fraud involving its officials and employees, shareholders, vendors, contractor, business associates, policyholders, assignees, claimants, nominees and outside agencies doing business with the Company or any other parties having relationship with the Company. Any investigation activity required, will be conducted irrespective of the suspected wrongdoer’s length of services, position/title/designation, or relationship with the Company.

4. Definition:

“Fraud” in relation to affairs of a Company or anybody corporate, includes any act, omission, concealment of any act or abuse of position committed by any person or any other person with the connivance in any manner, with intent to deceive, to gain undue advantage from, or to injure the interests of, the Company or its shareholders or its creditors, policyholders or any other person, whether or not there is any wrongful gain or wrongful loss; “Wrongful gain” means the unjust financial/monetary gain by an unlawful means which shall include all notional and/or actual gains; “Wrongful loss” means the unjust financial monetary loss by an unlawful means which shall include all notional and/or actual gains.

5.Types of Fraud:

This Policy shall cover following types of frauds:

  • Internal Fraud:

Fraud, misappropriation, misrepresentation against the Company by its Director, Manager and/or any other officer or staff member (by whatever named called). The illustrative Internal Fraud lists include the following but not limited to:

    • Embezzlement (i.e. misappropriation of money, securities, supplies, property or other assets);
    • Fraudulent financial reporting (e.g. forging or alteration of accounting documents or records;
    • Cheque fraud (i.e. forgery or alteration of cheques, bank drafts or any other financial instrument;
    • Overriding decline decisions so as to open accounts for family and friends; • Inflating expenses claims/over billing;
    • Paying false (or inflated) invoices, either self-prepared or obtained through collusion with suppliers;
    • Permitting special prices or privileges to customers, or granting business to favored suppliers, for kickbacks/favors;
    • Forgery or alteration of documents or accounts belonging to the Company; • Conflicts of Interest resulting in actual or exposure to financial loss;
    • Payroll fraud;
    • Tax evasion;
    • Unauthorized or illegal use of confidential information (e.g. profiteering as a result of insider knowledge of company activities)
  • Unauthorized or illegal manipulation of information technology networks or operating systems;
  • Intentional failure to record or disclose significant information accurately or completely); and
  • Improper pricing activity.

B. Insurance Fraud

Fraud against the Company in the purchase and/or execution of an insurance product, including fraud at any time during the tenure of the policy. The illustrative Policyholder Fraud lists includes the following but not limited to:

Staging the occurrence of incidents;

    • Reporting and claiming of fictitious damage/loss; • Insurer reported medical claims fraud;
    • Fraudulent claims including death claims;
    • Wrong information pertaining to the claim;
    • Wrong information on the exact cause of loss/damage;
    • Unauthorized transactions being initiated on policies such as switches, withdrawals, surrenders etc.;
    • Unauthorized changes in contact details;
    • Non-disclosure of material facts;
    • Misrepresentation of facts in the Proposal/Claim form or any other document; and • Submitting of forged documents.

C . Third Party Fraud:

Any fraud done by a party other than the persons connected with the Company will come under Third Party Fraud. The Third Party Fraud lists includes the following but not limited to:

  • Fake or forged receipts and/or policy documents issued by third parties;
  •   Spurious calls by third parties to customers promising them inflated returns for purchasing new policies or on surrender of their existing policies;
  • Connivance in making fraudulent insurance policies or claims documents;
  • Kickbacks to employees for deficient or services or provided;
  • Forging of cheques, signatures, policy document, claim document or any other document to defraud the Company; and
  • Stealing Company assets like laptops, computers, cover notes etc.
  • Online Fraud:

This type of fraud could inter-alia involve any fraud committed while buying online policy on the Company’s digital platform. The Online Fraud lists includes the following but not limited to:

  • Buyer side: filing fraudulent claims or making premium payments using compromised payment cards.
  • Merchant side frauds: Frauds committed by any of the merchant partners of the Company which would include non-remittance of premium collected on behalf of the Company and/or incorrect charge backs etc.
  • Cyber security frauds: Transactions effected through fake or stolen credit card/bank accounts to carry out a transaction in the web portal of the Company.
  • Data leakage: Threat of confidential data of the Company being comprised due to any cyber-attack/hacking of the Company systems.
  • Other Frauds: Phishing emails sent to customers promising them inflated returns. Using social engineering techniques to wrongly influence the customers to share their identity details.

6. Impact of Fraud:

Fraudulent activities not only impact a Company’s bottom line but also create reputational risks for the Company. Depending upon the type and extent of Fraud, the impact includes:

a. Financial loss;

b. Decrease in Profitability;

c. Negative publicity in press;

d. Deterioration in stakeholder relations

e. Loss of Customer’s trust; and f. Low employee morale.

7. Composition of Fraud Control Unit:

The Company shall establish an independent Fraud Control Unit (FCU) which shall commensurate with the volume and scale of business. The Fraud Control Unit will be dedicated function responsibilities for identification, detection, investigation and reporting of frauds. The FCU shall also be responsible to identify the vulnerable areas exposed to the risk of potential fraud and put in place adequate control for containment of fraud.

8. Procedures:

All functional head are primarily responsible for day to day management of activities and in charge of maintaining, implementing and improving their system and control so that they minimise the risk of fraud.

9. Identification and Reporting of Fraud and Prospective Fraud:

All the frauds detected by any department/or detected by any person with knowledge of confirmed, attempted or suspected fraud or any person who is personally being placed in a position by other person to participate in the fraudulent activity shall be reported to and by the functional head within 48 hours from the detection of any confirmed, attempted, or suspected fraud.

10. Reporting Mechanism:

The Fraud Control Unit is entrusted with the responsibility to examine and investigate the reported frauds. Any fraud detected by any person should be reported to the Fraud Control Unit as follows:

11. Investigation Responsibilities:

The Head of Fraud Control Unit, Principal Officer, Compliance Officer, or any other authorized person as the case may be, is entrusted with the full authority for the investigation of all suspected/actual fraudulent acts as defined in this Policy. They will take the necessary support from all concerned departments, external outsourced investigation agencies, and forensic experts, etc for investigation, if required. Moreover, the Principal Officer / Head of Fraud Control Unit has the power to form a team from case to case basis and such investigation team will be given all the rights, authority to investigate, any Company’s books, desk, cabinets, storage, emails, files or access, to any premises etc., whatsoever to investigate the case.

12. Prevention Mechanism:

The Company will inform both potential stakeholders and existing stakeholders about the Policy. The Company shall appropriately include necessary caution in the relevant documents, duly highlighting the consequences of submitting false statement and/or incomplete statement, for the benefit of the policyholders, claimants and the beneficiaries. The employees are regularly given training covering Anti Money Laundering, Anti-Bribery and corruption etc. Awareness amongst employees also created through regular circulars, communication via email and at townhalls/meetings etc. All fraud monitoring activities shall be conducted in adherence to the applicable provisions of the Digital Personal Data Protection Act, 2023, ensuring confidentiality, purpose limitation, and lawful processing of personal data collected during the course of fraud detection, prevention, or investigation. The Company shall also co-operate with insurance industry participants along with all the relevant government agencies including IRDAI to identify, detect, investigate, prevent, control and do all such acts that is necessary to mitigate any fraudulent activities.

13. Review:

This Policy will be reviewed by the Board of Directors of the Company as and when required.

This End User License Agreement (“Agreement”) is a legal contract between the User (“You”) and Synergy Insurance Broking Services Private Limited (“Synergy” or “We” or “Us” or “Our”), governing the access and use of all digital content, calculators, quote tools, policy management platforms, and other interactive features (collectively, the “Software”) made available on or through our website [www.synergy-insurance.com] (“Website”).

By accessing or using the Software, you agree to be bound by this Agreement. If You do not agree to this Agreement, do not use the Software.

1. License Grant

Synergy grants You a limited, non-exclusive, non-transferable, revocable license to access and use the Software for your personal or internal business purposes, strictly in accordance with this Agreement and any applicable laws.

2. Restrictions on Use

You agree not to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any part of the Software;
  • Use the Software for any unlawful purpose or in violation of applicable law or regulation, including but not limited to the Information Technology Act, 2000, the IRDAI regulations, and the DPDP Act, 2023;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software;
  • Use any automated means (such as bots or scripts) to access the Software;
  • Violate or attempt to violate the security of the Software or Website;
  • Use or access the Software in a manner that violates the intellectual property or privacy rights of any third party;
  • Upload or distribute malware, viruses, or any malicious code;
  • Attempt to access other users’ accounts or personal information.

3. Ownership and Intellectual Property

The Software and all content therein, including but not limited to text, graphics, logos, trademarks, and code, are the property of Synergy or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted to You other than the license expressly set forth in this Agreement.

4. Updates and Modifications

Synergy may update, modify, or discontinue the Software at any time without notice. You agree that Synergy shall not be liable for any modification, suspension, or discontinuation of the Software. Continued use after modifications signifies acceptance of the changes.

5. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if You fail to comply with any term of this Agreement. Upon termination, You must cease all use of the Software and destroy all copies.

6. Warranty Disclaimer

The Software is provided “as is” and “as available” without warranty of any kind. Synergy expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Synergy makes no warranties regarding uptime, reliability, or error-free functionality.

7. Limitation of Liability

In no event shall Synergy, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use or inability to use the Software, even if advised of the possibility of such damages. This limitation applies to the fullest extent permitted by applicable law.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

9. User Data and Privacy

Your use of the Software is also subject to our Privacy Policy. (direct privacy policy page ) All personal data collected is processed in accordance with the Digital Personal Data Protection Act, 2023. By using the Software, You consent to such processing and warrant that all data provided by You is accurate.

10. Consent Recordkeeping

We maintain a secure record of all user consents given under this Agreement for compliance purposes, including timestamped logs of acceptance and withdrawal, as required under the DPDP Act, 2023. Users may request access to or correction of their records by contacting our Grievance Officer.

11. Accessibility and Reasonable Accommodation

Grievance Redressal Policy

Synergy Insurance Broking Services Private Limited (“Synergy”) is committed to providing prompt and fair resolution of customer grievances. We recognize that a well-structured grievance redressal mechanism is essential for customer trust and regulatory compliance under the guidelines of the Insurance Regulatory and Development Authority of India (IRDAI).

Objective

  • To ensure that customer complaints and grievances are addressed efficiently, fairly, and within defined timelines.
  • To provide customers with clear access points and escalation channels.
  • To comply with the IRDAI (Protection of Policyholders’ Interests) Regulations, 2017, and other applicable laws.

Definition of Grievance

As per IRDAI guidelines, a grievance/complaint means any communication expressing dissatisfaction about any action or lack of action by Synergy, its employees, agents, partners, or service providers, in respect of:

  • Premium handling
  • Policy servicing
  • Claims processing support
  • Mis-selling or wrong representation
  • Delay in service or failure to provide promised services
